We were referred a case which we worked up for trial with an understanding that the referring attorney would receive a 1/3 referral fee. We now are bringing in a third firm in as trial counsel. We let them know it was a referral and a portion of the fee is going to the referring attorney. They suggested a 50/50 fee split on the verdict. Would you assume this suggestion is that we split the remaining fee after the referring attorney is paid or that the referral fee comes from our part?

Please help! I’m a CRC who manages Investigator- led clinical research projects and I want to transition to a PM role in industry (I would slightly prefer not a PM role in clinical trials since I don’t have clinical trial experience.) What metrics do you think are most important to measure for success of a Plaintiff’s firm? Obviously revenue, but what else is at the top of the list for you?

I received a job offer from a PI firm (MVA and tractor trailer cases) in Houston, Texas; the bonus proposed was 2.5% of attorney’s fees for any cases settled each quarter. We are assigned 50 cases a quarter and the top attorney clears $25K each quarter. This is my first time working at a PI firm. Can anyone share any guidance? Is 2.5% industry standard? Is it realistic to settle/resolve that many cases? I am trying to learn more about this niche before I counter-offer and attempt to negotiate.

What's your preference for plaintiff's side? Steady pay at approximately $120k with no bonuses, or a base salary of $70k plus a cut of what you close over a minimum threashold? Midwest-ish market. In both situations, you get a cut of what you bring in.

I have a dumb question... I have my first jury trial coming up in a few months. It's a 3-day auto accident trial. I'm the plaintiff attorney. My question is, should I have my client present the entire three days, or am I okay to tell them that they're fine to leave after they testify?

In an auto accident trial, can you inform the jury in any way that the at-fault driver had insurance? I have a hard time believing a jury would award 7-figure damages if they thought the little old lady defendant had to personally pay. Hi all, new-ish associate here at a Virginia firm - quick question: if a pleadings filing deadline for a GDC case ends up being on a Saturday or Sunday, does that mean that it can actually be filed by that following Monday since the court and clerk's office will be open then?

Anyone know a Connecticut or 2nd circuit case for this rule? I can’t find one to save my life. A defendant generally is liable for all harmful results that are the normal incidents of and within the increased risk caused by their negligent acts. If a defendant's negligence was a substantial factor in producing the plaintiff's injuries, the element of proximate cause has been satisfied and the defendant would not be relieved from liability for those injuries even though another force concurred..

4th year at a mid size PI firm. Got pulled from litigating MVAs to help this solo we hired start a med Mal/nursing home practice. 1 year in and it looks like I’m two steps backwards in terms of getting paid because we’re a year or more out from a lot of the fees hitting. I respect the solo a lot, he’s a mentor, but I’ve got kids and I gotta get paid. Trying not to burn bridges, but I can’t wait years to get cut in. Advice?
