It can be proven just not efficient from a resource perspective. In theory I think all you’d have to do is track job postings, the number of applicants, quality of applicants (aka do they meet the credentials or at least most), and how many times the job gets reposted. Government already tracks a lot of data for EO enforcement, but I’m sure making it this targeted and intentional would cost serious money - like you’d need a task force or something.

I agree, but no applicant would readily have or know the numbers or quality of applicants on a posting to prove the posting is fake. Firms like public accounting also recycle posts even though they’re not *really looking* but will roll the ball if they get an exceptional applicant.
Bigger companies are always hiring and firing. And no government entity will waste resources in trying to prove a small manufacturing or PE firm is faking posts. Like you said, it’s time consuming and inefficient. And for what? A 50k fine?

I would think it’ll be tough to prove that they are fake. They could quickly move to hire a dummy and prove it was a legitimate posting rather than spend legal defense fees- would be hell of a lot cheaper.
Depends on the definition of fake job - you referenced what is generally referred to as “sourcing requisitions”, these are not fake but rather, as another pointed out, big companies are always “hiring and firing”, they also have folks being prompted, moving positions internally and resigning. FAKE jobs that legislation may or may not get around to prosecuting are those postings by predators promising unrealistic non-interview positions with unrealistic salaries but with the caveat of you must give them money for placement fees, supplies, etc or ask you for your SS #, bank info, etc.
Quit whining if you responded to a sourcing requisition and received no response.

They own your information once you submit your 'applications' then they turn around and sell it for $6-$8
If someone tried to pass that law, some people would be inclined to call it socialism and an overreach by the government.
