Does anyone have experience working for a ALSP? How does compensation work (pay and benefits)? Are you an employee or technically an IC? Do you have billable requirements like at a firm? If a lien was placed in one persons name on a property held in joint tenancy with survivorship and the party who’s name was on the lien (one of the joint tenants) dies what is the status of the lien?

A client developer group just told me they reached terms to “buy equity in a lease.” From what they’ve told me, if we were setting this up fresh, I’d do a new LLC and easily handle capital contributions, buy-sell, etc. in the new LLC agreement. However, here the partner had a long-term lease on the underlying RE that our group wants to develop as a concept. Lease assignment to new LLC is dicey, but I’m thinking maybe we set up a Mgmt services company to contract w/ the partner-tenant entity?

Has anyone ever heard of this type of real estate private equity fund structure:

-One LLC, so only one PPM
-Multiple investors that can be onboarded anytime
-Multiple investments that investors can determine whether or not they want to invest in
-One K-1 per investor based on their investments and income
-Ability for the Sponsor/Fund to invest directly, indirectly and in equity, debt, Pref, etc.

Pro se plaintiff, an attorney, filed a complaint alleging mold defects after closing on a property. Client, layperson, may have agreed orally to a settlement amount without proof of damages prior to filing appearance and obtaining an attorney. Client filed appearance pro se, then plaintiff sent over a draft settlement agreement few weeks later which client didn’t sign. Client then got an attorney, filed answer, etc. Can this oral agreement be voided for coercion, indefinite mat’l term, etc?
