Get a note from a doctor or better yet from an audiologist, that explains your hearing loss. When you go to the director or HR, give them that note. I’ll tell you, I have rheumatoid arthritis (from a very young age of 24) and I also suffer from colitis and migraines. I learned early on that a doctors note is all you need! Good luck!
This is a bit “neither here nor there.” Even if someone was not disabled, it is the disability-motivated harassment that is the breach. Say OP had complete hearing ability, but some nutjob at work was harassing her about being deaf, or similar. Another example, XYZ employee is getting bullied about being gay- even though employee is not.
I have a few questions to clarify the situation:
- What actions are being taken against you?
- Can you explain how these actions are related to your disability?
- Is the director involved in this issue?
- Why do you believe they might terminate your employment?
- Does your disability impact your job performance?
- Your employer can request a medical examination to determine if you are fit for your role. If your disability makes you unsuitable for your current position, your employer will make every effort to find a more suitable role for you.
That was my situation. The bully was fine when pulled aside for 1:1 meetings. For each staff she pushed out. But out at the work area it was no holds barred because there was no one over her directly daily. There were a few times the docs noticed. And it was mentioned

Disabled is of course a protected employment class under the law. If the bullying crosses over into other types of harassment, it may potentially qualify as employment discrimination, a legal civil rights violation.
While there is no excuse for bullying of any kind, and I’m sorry you’re dealing with this, the key question is:
Are you being bullied/harassed at work *BECAUSE* of your disability (hearing impairment)?
OR
Are you being bullied/harassed at work *AND* have a disability (hearing impairment)?
Whatever the case may be, understanding there is bullying behavior happening, I would not hesitate for a moment to take this to your Director and HR department. As soon as you do this, you create a record of the situation that you will be able to point to later on, if there is need to do so.
If the situation remains “hidden,”- and by hidden I mean “on paper,” whether other people seem to be aware of things or not) and anything should happen, including job loss, you have only your word, and are left with nothing you can actually point to.

Yes and no. If you document your complaints of verbal bullying in a way that illicits need to respond they will have to acknowledge it did or did not happen and why they came to that conclusion.
Had a physician yell at me and I our in person meeting we discussed my work more than his yelling. I followed up with an email recapping the event. Recapping the in person meeting and that I was unsatisfied with the discussion as we did not actually discuss what the meeting was held for and then I asked for next course of action per policy when a physician yells at staff.
I was acknowledged and an email was returned with an actual action plan.
It was all documented too so that if later I was forced out or let go I had evidence it could be because I rocked the boat in demanding a physician be held accountable for their actions.
Well being bullied at work is definitely not okay. Have you told HR about yoru hearing impairment? If they have it on record and you can prove they are bullying and harassing you those people could lose their jobs. I would defintely go to HR and let them know what is going on. Be sure that you document everything.
I would definitely speak with a lawyer and start documenting everythign that's happening. Of course bullying is illegal whether or not you have a disability, but its especially egregious given that you are hearing impaired. I'm really sorry this is happening, I would start writing down everything that's happene (and continue to do so) and then get in touch with a worker's rights lawyer
To RN 1, speaking to an attorney will not do any good if the employee did not give the organization the opportunity to rectify the issue. Medical Assistant, it is wrong for anyone to bully any other team member whether they have a disability or not. The fact that you do have a hearing impairment may qualify you for additional considerations and workplace accommodations. You should follow that path for a workplace accommodation, but should also speak to your HR Representative or file an anonymous complaint. It may challenging to file an anonymous complaint as those are much more difficult to investigate and come to a resolution. I hope this helps. Please take action as no one deserves to be treated unprofessionally.
I believe it is harassment as opposed to bullying. And not only is it unprofessional but also unethical, considering the environment of which you work. I would definitely mention it to your supervisor or director because your dept. won't have much teamwork if you are being singled out for a handicap or disability.
Yes it is against the law to bully someone with disability of any kind. Research the disability act law. That is a lawsuit. Just like you're not obligated to tell anyone if your disability..that's is HIPAA law. Whenever you fill out an application for a job especially online it will ask you if you have a disability. It will also have it listed, you chose yes if you do. Bring that issue to your supervisor attention, if it doesn't help..get you a lawyer. You can also contact the head of your supervisor or HR

Sorry to hear of this news, unfortunately, HR is never for you, the company says so, but, all lies! HR will ALWAYS be for the company! Your options are involving your primary care doctor so that there's documentation in your chart. If you're unionized or labor law. Once you get your doctor's note forward it to your HR rep, and explain your situation of the bullying. Make sure you received the minutes from your HR rep, so that you have read and made corrections if needed from his/her notes. Download a app that you can keep notes or carry a pen and pad. Write the dates and times of each incident and report them. If 30 working days have passed and the abuse continues. Contact your union if you have one or labor law in your state. All the best to you! I also would request to see my employee file, just in case those assholes placed any false documentation to make you look bad. You have a right to copies of your file as well.
HR is definitely for the company not employees so going to them is only beneficial to have it documented. Other than that ask a lawyer
Definition of bullying is subjective. It’s part of life to learn to work with people who you feel don’t like you or bully you. Address it with them first and explore resolutions and if no improvement then you can go to your boss or HR but many times when this happens complainers are let go.
In my state they can let you go for any reason at anytime so inability to get along with coworkers could be the reason I would address it with them and try to resolve the conflict on your own as it’s a great life skill to have one you need in all jobs.
Do you have an employee representative? When I was Director of Social Services many employees came to me with complaints & I spoke to the Administrator on their behalf. Hope this helps.

Make sure that your job is aware that you have an actual medically verified disability ie. Hearing impairment in the left ear, a letter from your doctor would go a long way to provide concrete evidence of the disability. This way HR can't say they were unaware of the medical condition. Assuming you have had no problems with your performance at work approach HR with a friendly attitude and bring up your concerns that there might have been some misunderstanding in your department and you just wanted to make sure everyone is aware that your disability is real and verified. That way no one can accuse you of being hostile and ranting about being picked on.
I am born deaf in my left ear and wear a hearing aid on my right. I'm sorry you are getting bullied. I personally don't know of anything for hearing impaired, but bullying of any kind should not be tolerated

Bullying is a law anywhere don't tolerate it from no aspect contact eeoc nd file a complaint or find an attorney they will be glad to take the case
