I'm not a lawyer to explain this, but I'll try. Most prenups are put in place to prohibit access to ownership of assets, accounts, or contracts. The moment you marry, a judge will deem everything you have earned (salary, bonus, dividends, cash from selling your startup, patent decision in your name, etc) as created by and through your marriage and for the purpose of enriching/securing/providing for your family (of which there are now at least two - you and your spouse). Doesn't matter if you did all the work and spouse stayed home reading blogs. This is all before lifestyle adjustments such as child support and alimony, too. Generally, people who have vast family wealth holdings will have a tax advantaged holding vehicle, such as a trust or foundation, to safeguard those assets by having the entity own them instead of any single person. It will then appoint family members as trustees or their lawyers as proxies so they can have access to the holdings without technically owning them. Typically, effective prenups will regulate the authorities of each spouse in relation to representation to those holdings. Tl;dr a prenup is more of a manual and less of a padlock of your assets. If and when a prenup truly gets challenged in front a judge, you'll be splitting your 700K in money maker funds or municipal bonds or whatever minor personal holdings you have. If you really think you need a prenup, do not talk to a family lawyer because they'll say anything to convince you to get one and pay them to draft it. Talk to a judge if possible, or a tax lawyer who does HNW representation. It'll run you 700 bucks an hour for the latter but well worth it if you have assets to protect or are considering marrying someone who you believe will make you need to trigger a backup contract like a prenup.
This just makes me sad that people get married and write prenups. If you love someone, you shouldn’t need it #hopelessromantic

Prenups are a waste of time and at best only backwards looking. The moment you marry, every dollar of income or capital gains is discounted by at least 50%. I'm telling you as someone who is married and whose father is a family law judge. Get it if the paper makes you feel better or you have family assets you need to shield. Which if substantive, are already ring fenced away from your ownership and only at your disposal.
All agreements are “disputable” I believe. Assets held in Trust accounts I believe are shielded.

There is a lot of truth to what d3 said, I've setup offshore vehicles that acted very similar. Usually the government / courts use a test of control to determine ownership. The vehicles are also not cheap to setup or maintain, however, a prenup can establish a framework for dissolution of the assets in case of a divorce. There is little downside to not have one even if it is not bullet proof.
50% of all marriages end in divorce. If you marry someone and don't recognize that reality of that situation maybe you're not mature enough to enter that commitment.
Basically what D3 is saying is prenups only protect the assets you have pre-marriage. Anything earned thereafter is going to be split 50/50 in the case of a divorce.
