I did this. Plaintiff work can be awesome, but the hustle is real. I got off the billable model but I was working way more (2300+ hours a year). That’s definitely not everyone’s experience, it just depends on the firm.
I liked it better in the sense that the client pressure was different and there was more autonomy.
The pay can also be really good depending on the firm. However, the volume of work was a lot, and in my experience, a lot of plaintiffs firms are very understaffed.
I also think the type of work can be stressful for some. For example, if you work in B to B litigation now, transitioning to talking all day to people who are paralyzed from a car accident or dying of cancer can be a lot emotionally.
People say that about plaintiff attorneys, but the only lawyers I know with private planes are plaintiff lawyers ;)
All kidding aside, there is a wide disparity in attorney pay across the board. Base salaries can be lower plaintiff side with possible huge EOY bonuses, just depends on luck and case staffing. Definitely talk to people at lots of different firms to get a good understanding of salary.
The stresses are different. You actually have a real client now as opposed to a corporation. Some of these people are the “daytime tv crowd” where this lawsuit may be the only thing going on in their lives. Many of the clients have unrealistic expectations and managing said expectations is an art form (the commercials touting million dollar settlements do not help). There is a reason why plaintiff-side PI is the practice area with the most grievances. You have to be much more of a people person and your social/emotional smarts are now important/relevant to your job. If you lose at trial as a defense attorney, it’s just an insurance carrier’s money. As a plaintiff, you are losing people’s ability to put food on the table. Stakes are higher. Also, putting all of this aside, it is definitely a different mentality now that you are the one with the actual burden of proof. I prefer this, but it can be an adjustment for people coming from the other side.
