I thought that it had to be a financial reporting oversight role? Mid to low level finance positions are not oversight, they're not the VP of SEC reporting or something.
Pretty positive this would violate independence
OP I'm pretty sure that's a no from PCAOB and not just OGC. Feel free to write a thank-you note to what's left of Enron's C-suite.
There's no materiality for fraud risk
Are you a partner? Why can't you just not work on the client and not be a covered person? That exists in my office for several people I know.
The scenario has been evaluated by legal at a high level and that was their conclusion as well. The position though, is not a traditional accounting role, though in the role my spouse would be working with third party settlements, though they are quite immaterial amounts to the organization. I live in a smaller market and EY audits half the big organizations in this industry. Given my spouse and I work in the same area of specialty this severely restricts his job prospects. I have to believe somewhere in the firm this scenario exists where the firm allowed a spouse to work for an audit client in this role, possibly based on the immateriality of the amounts connected to the accounting function.
I am a career SM and this client is 40% of my BOB. I've been on the account for almost 20 years in different capacities. It would be very difficult to give it up and maintain my sales and TER targets.
Per OGC this policy applies to any family member working in any Accounting Role at an audit client, including clerical roles such as AP, A/R, purchasing, etc. I am checking with the PCAOB to confirm materiality of the role is not relevant.
