Does anyone have any insight to wage loss in a personal injury case. We have a client that lost her contract as a result of a policyholders negligence by not following the rules of the road and injured our client. now the insurance company does not want to pay her for her lost wages. We have sent supporting documents but the adjuster is not paying.

NF filed (if applicable in your state)

Did the accident cause her to lose contract or her injuries. You need to spell out what the cause of the loss is. I.e. her car is total and needs a car work, so they cut her contract or she is injured and can't do physical labor so they cut her contract.

Hi. How do most plaintiffs firms deal with payment for a private investigator and comport with the ethics rules? Do you always charge to client unless indigent? Can the firm eat the costs if client is not indigent or is that a violation of rule 1.8? I understand it varies state by state but trying to get a general understanding.

How do y’all handle attorneys fees award in your retention agreements? Right now I have it as basically a bonus in addition to the contingency, but I have a potential client asking that it be deducted from the gross amount for purposes of calculating the contingency.

My thing is, the fight for attorneys fees is a huge fight in and of itself (not to mention rarely awarded). What incentive do I have to fight for a fee award if I’m not really benefiting from it??

A couple of weeks ago I filed a default package, asking for 60k. Mind you, to get to this point, complaint was never answered, statement of damages was served, heard nothing, request for entry of default filed and served, heard nothing. But now, out of the blue, my firm gets a call from defendant’s attorney, asking us to stip to put aside default. Thoughts on how to proceed.... do I agree to stip? Or do I tell them to shove it just like they did to my clients complaint?

Question from a non-PI lawyer, if there is a car accident that causes a major injury or even death to a passenger at the fault of the driver, how far will the civil liability go for the driver? If the driver is an adult, could the plaintiff/their estate go after future earnings? Could they go after the driver’s family for recovery? Or would it just be limited to the insurance policy?
