It’s all discretionary. I have friends who negotiated three months. I have a friend who negotiated a year. What the agency offers you is to be scoffed at. Don’t sign a thing. Is this part of mass layoffs in which case they obviously do have money problems? Is it due to the loss of just one account? Did you work on that account? Was this a personality conflict they could be seen as bias on your boss’ end towards your gender, orientation, or age? Is there a history of issues like this with the person you reported to? Factor in everything. Just know that every day that you don’t sign their form, is a day that they are talking about you with increasing worry I’m getting more desperate to give you more. Why? Because the holding companies have policies that mandate them to get you off of their books, and because it looks bad for your human resources department if you choose to challenge this legally. So they are sweating, your boss is sweating, let them sweat. Then ask for at least six months. Settle for three.

I got four months after being there 6 months. They were wrong. They knew it. They paid for it. Had a nice summer break.

Nope, but you should consult a lawyer before signing anything. Happened to a buddy of mine and after he talked to his lawyer, he ended up getting a better deal than was initially offered.
If you’re in an “At Will” state like California there’s literally nothing you can do unless you have proof of discrimination.

I was laid off once from the worst job I’ve ever had. 3 months severance. Immediately started freelancing then moved Oceanside. Best thing that ever happened to me.
Most agencies are standard 1 week pay per year of service. I negotiated 3 months severance in a contract for a CCO role. Sure enough, I needed it 18 months later. Should’ve negotiated at least 6 months but it was a small shop. ECD-level roles are few and far between, fewer and farther for some. Plus November is layoff season at agencies so 2 months of little job traction over the holidays eats through severance real fast.

I was given a week of severance pay having been at the company for 1.5 years (entry level). Lol no it was a joke, but I guess that’s probably par for the course so early into a career.
Depends on your level. And tenure with your company. Were you a valued employee and it is really a lay-off? That matters. You can negotiate it but before you do talk to a lawyer. But you gotta be real even CEOs don’t get huge severance packages any more. Most people get a few weeks. 2 months is generous. 3 months is more generous and likely negotiated with a lawyer. Anything more than that is likely for people with 10 years or more or executive leader. Or has some beef with the company that could result in potential litigations. Do not sign anything. Also know you don’t have to sue to get more money. I have been laid off and when I paid hour or two to an attorney and they gave me their opinion on what I could get. I went back and asked for that. I NEVER told anyone I talked to an attorney. I verbally discuss what I want and even if they say no I put it in writing so they are obligated to respond to that. I did not get everything I asked for but I did get more than they offered.
Also depends on if you’re in a state where they have to pay you for accrued time off or if you’re a company who has unlimited PTO. They will also make you sign a whole lotta paperwork. Read it all and don’t sign immediately.

I got a week per year. I was at the company 11 years. Then I negotiated. Ended up with 16 weeks ( asked for more originally) and I think 2 or 3 months of cobra. Dont sign anything right away. Take papers home and take time to evaluate. I talked to a lawyer who said that If I didn’t have a contract, I had nothing to fight for. I didn’t, so it was being kind and fair during negotiation with HR.
