I was forcefully released from HCL services saying my BGV is not clear and was released the very same day. Now I am being asked to pay for basic salary of 89 days notice period +18% GST.. WHAT TO DO PLEASE HELP. I am being asked to pay 1,65,000/- and I was forced to leave HCL in 22 days.

I’m about to give my notice at a firm I’ve been at for the majority of my legal career. They’ve recently offered me non-equity partnership (which I’ve accepted), w equity partnership on the horizon. However, I’ve been annoyed with their way of running the business and getting between me and my earnings far too long; and I received a lucrative offer to go in-house. Clawback clause in current contract: been in role for over 2 yrs, it was an internal move that required relocation. Relocation was approved shortly after (over 2 yrs ago) but covid meant the actual move and start of my contract with new subsidiary was delayed, I was paid by the previous subsidiary meanwhile. I got small relocation package. Would internal move be subject to a buy-out/clawback clause if I leave now and if yes, is it time in role or time under new contract? Any experience? Thanks!
