I have said exactly that to many clients. Often followed by something like everyone in the courtroom gets paid either way and I’m not the one going to jail
Most judges are biased and should not be on the bench and most jurys are stupid and make lots of mistakes.
I tell them if you want a "sure" outcome, that is what plea deals and settlements are for. Judges and juries are unpredictable gambles with blind odds.
Litigation is a risk because you're injecting another person or more people into a dispute. Sometimes things happen that shouldn't. They need to go in with eyes open to that, and you telling them that isn't you trying to weasel out of doing hard work. If they want a cheerleader, they shouldn't go to a law office.
I used to tell criminal defense clients that I will certainly try their case regardless of facts. Trials are fun. But for me, I get to go home afterwards regardless of what happens.
Jury trials, in particular, are a gamble. I would counsel clients to be very cautious about taking that risk.
