Usually the policies have a date by which you must be employed to be eligible for bonus. Beyond that, bonuses are discretionary not guaranteed. Discretionary based on your and company performance. The one who did get the bonus, what was diff about their employment situation? Hard to say what happened here but you can check with an employment attorney
Thank you!
As others have said, unless you are an employee as of the date the bonuses were paid out (ie went into your bank account) I wouldn’t expect the bonus
Hell, even if I gave my 2 weeks notice where I’d technically be an employee on the bonus pay out date, I would expect to not get that bonus
My guess, HR just missed that person by accident, incompetence or weird timing of things.
If it’s not explicitly written then you just don’t get one- you’re not entitled to it
I just love the OP's phrase, "implicitly implied."
I doubt there’s any legal basis. It’s very rare to have a comp arrangement that doesn’t require you to be employed as of the distribution date. If it’s a completely discretionary plan, what someone else receives is not relevant
How would an audit associate get 10k bonus?
Because I’m not an audit associate. Profile was not updated at the time of posting.
If they never told you that you were to receive a bonus (the exact $ amount), you're likely not entitled to anything.
That bonus is sitting in the partners pocket right now, fat chance you will get it now. That’s why you leave right after the bonus hits your bank account
Yeah while it may not say this, it is pretty common knowledge that you need to be employed with the firm at the time of payout in order to receive your bonus. Trust me, I have played this game many times, including at two Big 4’s, and even an HR person told me not to give my notice until I received my bonus. Same for in house roles.
