IHCs on small teams, how do you track litigation matters? Excel? Asana? We don’t have enough lit to warrant a dedicated headcount for it, but we also get a couple pseudo-lit requests (think subpoenas) per month with their own timelines and action items. So maybe 50+ things to track over the course of a year. What’s your process?

We also link it to our matter management smartsheet so we can track how much we’re spending on outside counsel per matter (if relevant)

Do you have one person in charge of it or multiple?

If just 1 and there’s just a bunch of discrete tasks that are 1 and done, throw the deadlines on your work calendar, create a word doc listing the tasks, make a shared folder to store the docs.

If multiple people are involved and/or ongoing deadlines maybe make a new shared calendar.

I’m at a small company, under 50, but we get maybe a half dozen litigation issues a year maybe. We just kick them over to outside counsel.

You must be at a bigger company or perhaps in a more litigious industry.

I use Microsoft Lists. The only advantage to that over Excel is that I can report out specific columns. Initial setup was a pain but pulling reports for executives, auditors, and other members of Legal without having to manipulate the spreadsheet is pretty nice.

Although I know you don’t need to pass the patent bar to “technically” do patent litigation, would it be a dead end move to pursue patent litigation without a technical degree / admission to the patent bar? In other words, would most BL firms refuse to staff associates on patent litigation cases if they don’t have a technical degree?

Several RFP’s dropping lately of current clients … are our clients afraid of the new CD&R PwC sale? What if EY Deloitte KPMG starting taking away these big clients … gonna make it tight around here.

I’m an ERISA consultant for Marsh providing 3(21) and 3(38) services. I am interested in learning the opinion of in house counsel. Is it a priority in 2022 to outsource or mitigate fiduciary liability in light of the excessive fee lawsuits hitting employers? Would a trustee committee for a 401k plan hire a third party cofiduciary to share that risk? Lastly, what additional compensation should the 5500 signor receive when asked to be the trustee for a retirement plan?

How do I get signatories to fill in their company name correctly on a DocuSign PowerForm NDA? I’m not allowed to reach out to people in advance and prepare customized NDAs for them, because “everyone is automated” and “that’s too slow and causes too much work for them.” I moved the signatory info to the signature block and made a “Full Legal Name of Entity you Represent” line, but people still screw it up and I’m getting blamed. Outside counsel has been prepping company witnesses for a trial in August. It is my subject area so I am supervising outside counsel. I did not, however, choose the counsel. He is doing a really awful job. Co counsel is better, but not great either. Higher ups love the firm… I do not want to micromanage, but I have genuine concerns about outside counsel’s ability to try this case. Trials are rare, and I just don’t think these guys have actually tried many cases. Cont. below…

What’s a fair expectation for my first raise? Publicly traded co with ~2500 employees. I’ve been doing litigation with the company for almost 3 yrs and have only had a 2% cost of living raise so far.
