Docking or withholding base is illegal. That's wage theft.
Provided bonuses are discretionary and not yet earned, they could be docked. Wage law is specific by state. Look up regs in PLC.
Origination would depend on whether earned in California too.
I agree. OPs state probably prohibits docking base pay. Discretionary bonuses are another matter.
Am in a different state and my firm says they can’t fine associates for late time (they do fine partners). But chronic late time has been a basis to reduce annual bonuses for associates.
No way can it be legal to withhold your pay for this … no way. I hate bullies.
The better answer though is to just train yourself to enter time as you go, your life will be so much more peaceful (from a recovering last day/all month, 2k hours per year biller…)
As long as billing is in by the end of the month who cares? Clients aren’t being billed every 3 days so why even?
Many partners believe that some time is lost if it’s not entered contemporaneously or at least soon.
I enter mine timely but it came up in conversation with someone I work with who was away on vacation last week and didn’t have the time entered Friday. It’s hard when employers change policies and it’s leave or deal with it. I wonder what the ramifications are for a policy like this. Again, raises are subjective. But financials at my firm are based on hours rates and origination. I know my firm isn’t the only one doing this, so I wanted to know if anyone has successfully challenged a policy like this.
I’m not an associate and I’ve been with the firm for many years. I get my time in as I already stated. It’s about what they are doing.
No idea but I would think entering time would fall in the same category as clocking in and out for an hourly job.
My firm docks bonuses for late weekly time entries - this is a common practice in v50 firms (from my understanding - and both firms I’ve been at have done this). I do think it’s illegal for them to dock your base pay for this as others have said.
Same- our firm docks bonuses for late weekly or monthly time
My firm does it but only after 5 strikes on delayed time entry. The penalties then ramp up and flatten out
