Theyre basically unenforceable
If you are laid off, non-competes are null and void.
And mostly unenforceable- because they have to show “harm” and the fact that you can’t be stopped from practicing your craft - basically the onus is on the employer and rarely worth it
The clause says, the agreement is valid in New York. I researched , New York does legally allow Non-Compete clauses as long as it doesn't significantly hinder employee's ability to earn living. Could this potentially create legal trouble in case of layoff?
When u go to another firm just don’t update your LinkedIn and put a trusted colleague as your reference point. Problem solved
OP - what are the specifics? Most pdub ones just say you can't poach former colleagues and clients. In other words would have minimal impact, even if enforceable
