No. Severance
What "record" do you think exists?
They won't report more than beginning and end dates unless something egregious - like fraud.
Employers cannot say anything except the dates of employment
No, it's not a law, it's just being risk averse.
I should clarify when I say it's the law, state laws vary. You can sue a company for keeping you from getting a job, so they will be cautious in what they say. No one wants to bring a lawsuit on. If it was due to a criminal act, not sure what you would do. If it's because someone in upper management felt you weren't performing, ask them if you can be laid off so it doesn't hinder your next position or benefits.
Find a job. Get severance.
It's the law, they cannot ask or be told anything other than verifying the dates you worked somewhere.
OP, you may want to look into your states unemployment benefits rules as well. Some states won't pay out if you quit, some won't pay if you were fired due to something you did. Research your state- it may be best to let them fire you. Sometimes companies will lay you off, and say it was due to work availability. Just depends. Hard to give you guidance without knowing your situation, but don't worry about future employers, all they will be able to find out is the dates you were there.
It is law depending on the state
Save yourself the aggravation and plan ahead. Also, you can speak to your staffing resource planner and ask her if a different service offering needs your help. There's a ton of stories of people being considered mediocre in one team and star performer in other!
Go to dol.gov and see what a state can say or not say with regards to employment
Oh and D5, completely agree, this place has been an absolute shit show.
Depends if it's performance related or not.
They could, but they don't.
Depending how many other people are being exited, the package may have more than just severance (e.g. continued health coverage, outplacement, accelerated bonus and/or equity). Unless you really F'ed up or have a new job, don't just leave because you're scared to get fired.
Also, most companies HR policy is to only ask about dates. Small businesses or people that may talk because they know each other may ask details. You also have the option of saying you do not want a previous employer contacted. I did that when I had a disagreement with a manger on a job years ago, and explained that I didn't want them contacted because I didn't think they'd give me a fair reference based on "insert some bullshit here". It worked, because I had plenty of other solid references for them to work with.
I would start interviewing to be proactive. I've had a fear of getting fired since I started because of what a shitshow D has been, and casually interviewing has made me feel much more prepared in case it does happen.
But you don't want that on your record right?
How do you know you're going to get fired soon?
