If the client can afford hourly rates?
I’m not a criminal lawyer so I’m not sure. I just figure that is the way it would work. Hence my question mark. Sorry 🤷♂️
People usually want to know what they are going to pay you. Flat fee makes the most sense. Many times with someone in custody it's family members coming up with the fee. That's my two cents.
I think people often do flat fees for simple cases like a DUI, but charge by the hour (first requiring a large retainer) for more complex things or trials that can really vary in terms of how much work there will be.
I do not do flat fees for criminal cases. I don't even see how that would work unless it's cut and dry like traffic court.
What kind of criminal cases? And I'm in state court.
