Guys don't hijack the thread.. let's stick to to question
True EY2, my EB1 International Manager I140 just got approved - thanks to my time working out of the India offices. A few more months and we'd be able to hate on those job stealing H1bs together. OP, you need to make sure USCIS has received the amendment application before deploying - the FedEx receipt should be enough. USCIS sat on mine for 1 year, @EY2- I was able to steal 3 jobs during that time period
OP - might be a firm thing. At K we don't need to apply for a new lca every time
@K1.. it's not dependent on firm.. its law.. if ur client location is not covered in LCA applied for you then amendment is needed.. it's not a choice it's a must... sometimes firm apply multiple LCAs that cover all or most major locations and then you ok otherwise ur firm is breaking law and given that we hear stories of K not filing H1 any more makes me question if they r being audited
SA1 - thanks for the insights. Will ask our immigration on this. Does it matter if one has been approved for i140?
Nope, the guideline is, if you need a new lca, you need an ammendment
I actually read the whole USCiS guideline myself...it is very fuzzy on how to define place of work...so you may be based out of lets say NY office...and travelling to a client in California 4days a week...there is no cutoff defined in USCiS guideline that tells you the number of days outside your home office when you file a new LCA...bunch of other grey areas on what constitutes working outside vs just going for a meeting...so it depends on firm's interpretation. It is more strict in case you are doing an IT implementation by staying at client site full time. Also, afaik MBB doesnt file new LCAs for each project.
