Had a small collision. Other driver admitted it was their fault. I put a claim through their insurance and they denied me because I "failed to be on the lookout ". I got a copy of the police report and clearly states the other driver admitted they weren't paying attention.

Q:do I appeal with their insurance or get a lawyer? I'm afraid the lawyer will eat up the payout from the insurance and end up exactly where I'm at right now.

For billable hours in civil litigation and insurance defense, is 2040 hours for a 1st year associate on the high end in this field for a small or midsize firm?
