Your insurance should assist in the process / provide a lawyer if needed
To clarify, I had liability insurance. So my insurance wouldn't have to pay anyway. Would they even care?
I think you have neck and back pain and should contact an injury attorney.
That’s not how insurance works. Anyone can say they are guilty or innocent. The insurer determines the at fault parties and the % of liability. Depending on state, that % determines who pays for what damages. I’m guessing you said something that shifted more liability towards yourself since they said you failed to be on the lookout (there’s no way to determine that otherwise). It’s also likely the call was recorded and will use that in court against any charges. You should Google how the process works or faked an injury and got an injury lawyer since they work for free and only charge based on what is won from the injury claim.
Update - called them, told them wtf the report says x and y, they now will cover 😆
They were probably like, "well, attempting to deny it to see if they'd go away was worth a try, now we move on to plan B and low ball this fool."
Ugh, that’s frustrating! I'd start by appealing with the insurance, especially since the police report supports your case. If they deny it again, you might want to consider a lawyer, but yeah, they can take a chunk of the payout. It’s a tough balance, but it could be worth it if the lawyer helps you win.
