Had a trial where it looked like everything went well, then the jury comes back with a runaway verdict. How do you handle that? If you can look back and say I did my best, do you just chalk it up to jurors being unpredictable??

Absolutely. It’s not your fault if the jury gets it wrong after you did your best.

Happens….. best to have an honest after action review with yourself (your trial team)

Can you interview jurors in your jurisdiction? I always learn the most from juror debriefing. Don't do it yourself, they won't be honest if they feel you did something wrong.

Sometimes you can do everything right and still, the runaway verdicts occur.

That's really unfortunate.

Maybe a helpful exercise if you’re not doing it yet is going to someone else at your firm who knows little to nothing about the case and lay it out for them. Like a peer review on a paper, they can maybe see what you’re missing bc you forgot you took it out.

But at the end of the day, juries are always going to come back with verdicts that confuse us sometimes.

For all you retail people...are you experiencing a very slow holiday season? I am a retail manager and I feel like this season has been freakishly slow. I thought we would at least match last year's number or be up a little bit but we are trending down. I talked to employees of other stores in the mall and they are saying the same thing. Is anyone else experiencing this in their market?
