Wow. Where are you located? I'm in Chicago and had difficulty finding clients willing to pay more than $50/hr! It varies so much from city to city.

The jersey shore! Salaries are so much lower here compared to cities, so I’m shocked you aren’t offered more than $100! You’re getting LOWBALLED. Do not accept anything less than $100. Offer to send a writing sample to prove your worth.

Have any of you taken "low bono" clients while working at a firm? I want to take on a low bono client or two but not sure who would get the money. This is a contract opportunity through a non profit so I'm assuming a 1099 will be issued. The per hour rate is significantly less than my billable rate. I would (obviously) like the money but my real objective is just getting experience/networking since I recently moved to a new state and don't have clients of my own.

My client wants both parties to list assets & liabilities as an exhibit to their prenup without values, but waive the right to know the actual valuation of those in the prenup itself. My initial thought is this is a terrible idea & would probably make the prenup easily voidable since a main requirement for a prenup is for both to understand the nature and value of the other’s assets. I will research in my jurisdiction to confirm, but has anyone ever heard of/done this? Thoughts?

What do you think is a reasonable total fee for a prenuptial agreement where both parties have significant assets and there is some negotiation? What about for a dissolution with a complex asset situation and children? I had a prenup a few weeks ago that came out to $7,000 and another about $5500, and I didn’t overbill, but I am willing to write some off if that seems excessive or I am just slow. How does everyone bill for family law matters? Do you always bill hourly or is there some flat fee, monthly or quarterly fee structure that could work, even in contested matters? I have cases that the clients end up spending $20-$40,000 on a contested divorce and this is really out of their budget. I feel that if my firm could charge a flat fee of $10-$15,000, it would still be beneficial from a client predictability and volume standpoint and would generate more referrals.

Working on a divorce where the father is claiming that he is unemployed because of the previous administration’s actions with DACA (he was brought to the States as a child). I know that the memo rescinding DACA was ultimately vacated—but OC is unsure whether this would count as voluntary unemployment for child support purposes. I believe it does as the application period to renew DACA benefits was reopened in 2020. Thoughts?

Family law associates - how long have you been practicing and what is your comp structure?

I’m a second year associate at a small, but reputable firm. My caseload is almost entirely made up of clients who were referred to one of the partners but the partners are too busy so I end up taking the case. The clients are told up front that an associate, rather than a partner will be taking his/her case. I’ve run into an issue a couple of times where the client doubts my advice because I am only 2 years in. Has anyone else experienced this? How do I address the fact that I’m only 2 years in?

How do you as the attorney balance your advice with your client’s wishes? Meaning when what the client wants is not, in your opinion, in their best interest, when they want to settle for less “to be done,” or pay more “to get him out of the house,” when do you stop pushing back and give in? I’ve lost at least one client before for pushing too hard to get what they were entitled to when they wanted to give in and I’m fear I’m facing something similar now.

Does anyone have advice about interviewing somewhere with bad Yelp/google reviews? Is it OK to ask about it in an interview? Does any law office, for the most part, have “good” reviews, especially family law? The reviews I read on lots of law office pages are usually people who are accusing the firm of over-billing, not doing enough work or losing/obtaining an unfavorable outcome. Let's talk unhinged pro se opposing parties. We have one that emails the entire firm every few days with these SCREEDS that are like weird stream of consciousness accusations of baseless criminal and unethical conduct. So far there have been 2 emails already today. A GAL has been appointed and ordered to do a psych eval on this party, but is there any sense in responding in the mean time? Everything we say seems to get twisted.

I am in my second year as a attorney, I was a FL paralegal before law school and would eventually like to end up there again. I am in a very small rural area, pretty much only solos, and no FL solos appear to be hiring/expanding at this time.

Do you think experience as a DA or PD would be valuable, with my eye toward a future in FL? Both for the skills gained, and/or as a resume piece?

What are your client follow-up/communication policies or practices? I’m hearing more and more that clients don’t like the long periods of time with little to no contact. From my perspective, since I bill for my time, unless I have an update or need something, I don’t initiate a call. Also, clients hold on to important info and don’t initiate a call cause they’re waiting for me to communicate with them.

Small firm (my boss, me, & a paralegal). After a hearing I did not handle, boss intended to seek review of the ruling in its entirety. What was communicated to me by paralegal was to seek review of a portion.

Seeking review is now time-barred. Boss is not upset, but this is 1 case & 1 problem. There are other cases & other stories.

How do I talk to my boss about being more present (boss is never in office, has “too many” emails, never answers his phone) without being seen as insubordinate?
