Not sure where the blame lies. If she had previously neglected court filings, why would you assume she would follow your instructions on this? I had a trusted paralegal for most of my career— one that i would even ask to confirm some procedures— but i would still fuss about filings because sometimes things go wrong without her being negligent. There is a reason that the buck stops at the lawyer’s feet.
Oh I am so sorry. You do not deserve this treatment. This is YOUR firm and YOUR risk and expense. There are plenty of legal assistants who would jump at the chance to work for you that would be hard working and diligent! Don't waste another minute or dollar on your current person please. Liz
Just to leave no doubt on how horrible she is:
Gave a motion that needed to be filed on a certain day. Thinking the motion would be filed I don’t inquire further then the next day I notice she sent me an email saying: sorry I had an emergency so I couldn’t file the motion by the deadline”
She didn’t even have enough courtesy to send me a notice to let me know so I can make alternative arrangements to have my motion filed. I can understand an emergency but I can’t understand just not saying anything.
I don’t have a solution but don’t underestimate how much care you need to take in this transition. Legal assistants are hard to fire and they can make your life miserable.
I’ve had a ton of incompetent assistants, and I’ve often just ignored it. The one time I did successfully transition away unscathed, I asked to have the same assistant as a partner I worked with a lot so there would be synergy (e.g., I could easily send that secretary his handwritten edits—-she supported me so she didn’t have a problem doing it, and she also could read his handwritten and was used to his style.)
I do not have good advice but I totally sympathize with your situation and agree with A1. If the assistant has been there for a long time and has not been fired, it could really get you in trouble even if she’s that incompetent and bad… To the point that I now understand why some lawyers just ignore the bad assistants and do everything themselves instead of trying to raise the issues to get the assistant to improve. It depends how long you’ve been there but if you’re a lateral it’s best to just do everything you can to avoid working with her. I know one lateral who was pushed out and one of the reasons was not getting along with assistants even though it was notorious these assistants were completely useless but they had a longer tenure than the associate.
