I graduated with a paralegal degree in December and have a job as a legal assistant. I'm enjoying the team, but the work is more administrative than I expected. Should I remain in this role for the experience, or would it be better to keep looking for paralegal positions? I would definitely like to do more research than admin work.

This is common, even in paralegal roles. I am finishing up my paralegal certificate after having over a decade of experience, and the emphasis on legal research and writing in the certificate programs is not accurately represented in the actual profession.

Most legal research is performed by associates or law clerks / interns who are in law school, as is most complex drafting. That said, if you have the skills and the bandwidth to flex your writing ability, volunteer to do a first draft of a response or opposition and see if your attorney likes your work...

If you want to do a certain type of work, you're going to have to make a grab for it and take the initiative in this field...training is generally non-existent, and we learn by doing.

My first job out of school was as a legal assistant too, and I remember feeling a little disappointed that I wasn’t doing the kind of research and drafting I was trained for. I decided to stick it out for about a year because I liked the team and the firm’s reputation. During that time, I made it a point to ask the attorneys if I could help with legal research or reviewing discovery. Little by little, they started giving me more substantive work, and eventually, I transitioned into a full-time paralegal role within the same firm. If you enjoy the team, it might be worth having that conversation before looking elsewhere.

Like … research case law?? I’ve worked at 6 different firms and have never seen a paralegal do that type of work. Nor would I ask a paralegal to do such work.

I have done legal research and explained the law to partners who asked for help. Though different takes by different firms I guess. Also I do have a JD. That maybe why. 🤷🏻‍♀️

Are there paralegals capable of excellent legal research, yes. Is legal research a common task for paralegals in my realm of Southern California business litigation, no. Is this your first law firm job?

Any advice on a first year trying to transition from family law to in-house? I always thought family law was my path, and used to enjoy it, but it’s not the direction I want to head in anymore.
