I was in a client meeting and got grilled on three obscure FMLA hypotheticals like I was a human Google search. I felt like an idiot afterward for needing to double-check the regs. Do you ever feel like you're not allowed to say, “I’ll look into it,” without sounding incompetent?

It’s way better to say you will look into it or “I don’t know” so long as you tell them what you are gonna do to run the issue to ground. This is way better than giving off the cuff conclusions that may be wrong or when you might not have all of the facts.

I no longer care at all if someone thinks I don't have entire bodies of law memorized and ready to answer off the top of my head. With that said, I try to get the client to tell me the general questions at issue before hopping on a call, but if I still don't know the answer I just say something like "the FMLA comes with a large number or regulations that cover a wide number of scenarios, many of which don't come up very often. Because of that, before I gave you a definitive answer I'd want to review the applicable regs to make sure I'm giving you the most accurate advice." Also I like to compliment their question like "wow, that is a really tricky one" and reiterate that was a smart choice to bring to legal.

No. I’d rather say I’ll look into than give an answer I’m not confident about. FMLA is a very fact-specific area too. It’s kinda tough to give advice that can be broadly applied.

Hello, I’m an associate (almost at the one year mark) at a midsize firm on the EPL team. I did about 2 years of employment law as a clerk during school and know that’s what I want to go into. What is considered a “large” caseload in employment litigation? I work at a large L&E boutique law firm and handling about 14-15 active litigation cases in state/federal court or arbitration. Some of these matters are multi-plaintiff and multi-defendant cases, but none are class actions. This does not include any matters I am handling in the charge stage or in pre-litigation.
