No the actual law requiring OT pay is federal. Kicker was it was not indexed to inflation when passed so it was stuck at an impossibly low salary until 2016, which raised it through exec action to $47k. As mentioned, this has been reversed and therefore the threshold is once again whatever it was when the law was originally passed.
Also tell her that she should leave after 40 hours because of self respect. That work will still be there tomorrow.
