Go through with the hiring process with the firm note that your start date is late January. I think that's the best you can do with things in your control
Don’t stay for the trial. Leave sooner rather than later. It will give the old firm time to cover the trial. Also talk to the new firm about why you’re wanting to start sooner. If they really have a better WLB, they’ll understand.
Same exact thing happened to me. I left sooner rather than later. I don’t regret it one bit.
Get a signed commitment to the new firm with a start date of March 1, 2024. Tell your current employer your last say of work is February 1, 2024.
The current employer will be grateful to have two months notice and the new employer will be glad to see your professionalism.
As wise perspective. I amend my preceding post accordingly:
Offer to you current employer how they want to proceed. Give your current employer the option of how long they want you — but no later than February 1. 2024. You can effectively transition off cases and focus on trial or they can curb you earlier.
When I had an associate leaving, he let me know in September he was leaving by the end of December. Took me all that time to locate and hire a replacement. And he still messed up a bunch of his cases on the way out the door — even with that much lead time. For me, that time frame ‘worked.’ For your current employer ……….
Cont. For sticking through with this trial when my wlb and mental health are deteriorating. At the same time, I don’t want to leave the client and other teammates in a bind AND I don’t want it to look disingenuous to the new potential employer that I’m backing out of a prior commitments. Do I tell the potential bew firm I’m ready to move sooner? Stick it out and keep in touch with the potential new firm? And am I kissing a great opportunity goodbye by sticking it out?
Man that is a tough spot to be in OP, and I have been there before. Your mental health and taking care of yourself should be your top priority though. I would say not to lose out on an opportunity at the exepnse of your physical and mental health. /
Tell the recruiter that it looks like the case will be settling so you can now leave earlier. Most attorneys are expected to give a 30-45 day notice so you can work that out. Be honest with your current employer after you sign your offer letter. Tell them you need more work life balance for the sake of your mental wellbeing. This way they’ll know they can’t dump on you on your way out
