I don’t totally follow this post. However, the way I’ve usually seen it work is that you have a short time window (like 48 hours) after you’re presented with a PIP in which you can either sign it or take a payout. If you sign it, they monitor you for the time period specified in the PIP — usually 60 days, some companies do 90. I don’t believe they can fire you before that time period elapses, except for cause if you violate a company policy or something.

Hoping you recover well and always remember to put yourself first!! Sorry to hear this is happening to you! I actually just got out on PIP too, strongly considering requesting FMLA after the passing of an immediate family member and this toxic workplace.
I took an FMLA leave before with my previous employer, not on PIP, and as far as I've learned that would be a VERY slippery slope for your employer to tread on if they decide to fire you now that you've submitted the FMLA (assuming you had a medical profesional involved in your case). Thankfully we have far more rights and protections under FMLA especially in certain states. Your employer would be risking a major litigation especially if there's a correlation [i.e. your health] between the FMLA leave request and getting PIP'ed.
