Three weeks in to a new position, I was fired for contracting Covid, my first bout with the virus, after four years of following the rules and 7 doses of the vaccine, most recent in May this year. Let me tell you, the FliRT variant(s) is no walk in the park. Plus, I’m well over 60 and immunocompromised. The company tried to get me to work remotely while in the throes of severe symptoms. I refused and was terminated under the guise of “not a good fit.” Perhaps this was a blessing in disguise?

Potential discrimination on the basis of a medical condition and/or age. BUT OP said they were 3 weeks in, so they were probably still on probation. It also looked like the company tried to accommodate them but they were unable to do the work.

You need to speak with an experienced employment lawyer. You may or may not have a claim. Mini “special protections“ that applied to Covid were lifted. Were you perceived as disabled? That will have to be established by you at a trial. Were you eligible for leave? Probably not because you had only been employed for three weeks. Was an appropriate accommodation effort made? This is a fact question. You said that the company wanted you to work remotely, but you were too ill. Did you have documentation from your physician to support your statements? Were there any other factors that the firm could point to to support their position that you were not a good fit? Again, a fact, question,.

In the long run, it sounds like this may have been a blessing in disguise and you have other opportunities waiting for you. Best of luck with your job search and a quick recovery from Covid.

Thanks to everyone for responding, but I don’t have a leg to stand on—terminated within the 90-day probationary period and reside in an “at will” state. Just wish I’d done my homework by reading “red flag” Glassdoor employee reviews of company beforehand. Live and learn, as they say. I’ve been a member of the working world for over 40 years. It just amazes me how cruel and uncaring that world’s become. Sad, indeed.

Just because you’re in a probationary period and an at will employee doesn’t mean they can discriminate against you if that’s what they did.

My dilemma… I am an injury adjuster at a carrier experiencing high inventory that’s barely manageable. A competitor offered a higher salary and manageable workload. I find myself questioning - for every assignment - is this the issue I was asked to look into? Did I read that case right? Does this analysis make sense? I have an interview for an in house position (only attorney) at a small non-profit focused on conservation easements. I am a transactional associate at a mid sized law firm. The prospect of freedom from the billable hour and contributing to meaningful work are the draws.
