Why are you so hesitant? Looks clearly like this isn't a good fit, the sooner you move on, the sooner you both can find something that works.
If it’s really three more week then just wait three more weeks. Why try to start something with HR?
Talk to HR, our HR has their way to do things. They have a package and make the employee accept and walked right then. Or HR said after PIP, there is nothing.

Do the documentation required for the third and final warning, working with HR to see that you covered everything you need to. Why prolong what obviously isn't getting any better?
HR is getting guidance from legal so they want you to follow the process. Talk to them and make sure that they know exactly what the issues are, have them look at the documentation and see is anything needs to be done differently.
