What you're saying makes sense, there's no way we can really know what someone may say about us after we leave a job. A lot of organizations have a standard policy of not giving a lot of information about former employees. It's mainly for legal reasons, they don't want to risk being sued for having said anything defamatory about a former employee. Still, people could go off the record and denigrate someone, and there's really no way to know if it happened or if it could be proven.
There is legal recourse if they provide information that loses you the job opportunity. But you are very right, it's incredibly difficult to know for sure. No all bosses are professional.
