Thanks guys. New York State implemented WARN for a required 3 month notice period and severance on top of that only if the company was closing or if there were mass layoffs not for employees at will. I think you're also entitled to sick days you didn't take though. Sounds like the norm in our industry is a week for every year worked
No legal requirement for severance. But if the company has a written policy around it they need to honor it as the terms of your employment.
When I worked in NY, just a few years ago, the company gave 1 week per year worked. This was one of the big agencies. Three weeks per year seems unlikely.
I'm sure this is published on the dept of labor for N.Y. website, but can tell you when I was laid off 10 months ago, I got one week per year (wpp). Also, I've never heard of severance pay being mandatory for employment at will.
Got laid off in NYC a month ago. IPG policy is minimum 2 weeks and then once you hit 2 years you get 1 week per year after that.
Also, in NY state, you cannot collect unemployment until your severance runs out.
OP, you're not entitled to sick days you didn't take. You may be entitled to accrued but unused vacation - how much depends on the company as well. All questions your hr dept can answer best for your particular circumstance. I've worked at places that pay out all accrued vacation, and at one that only paid up to 5 (five) accrued but unused days of vacation.
