Oh no. Usually the only time an attorney claims support staff is toxic when they don’t (or refuse) to recognize that the call is coming from inside the house and they’re actually the toxic one.
Imagine expecting lower grade staff to perform on the output of a salaried employee, during a consecutive shift, 365 days a year. And worse, their pay is 1/5 your own.
Hence the T14 shift for me. 500 files with your name on it? Build a team, comparative negligence and no excuses with the reality. Get used to those 15 hour days. Doctors don’t complain. Nurses get paid more than our field, and have 3 days off.
In my experience, this is a sign of something deeper going on. Not to say that there aren't toxic people out there, but very few support staff are coming into their office with the intention of "getting attorneys in trouble". LP poses some good questions you should think about.
Have you ever had a conversation with this person? Do you really think their internal motivation is "to get attorneys in trouble" or is it to raise attention to an ongoing/reoccurring issue/problem?
Could it be this support staff is struggling with their workload, identified a problem outside their realm of control, and is reaching out to someone they think could solve the issue? Or provide other resources/alterntative perspectives to address the problem? Perhaps they are putting out feelers to see if anyone else cares enough/takes the job as serious as they do. Maybe it's a misunderstanding based on their tone or choice of language on their part and they need to work on being more effective with their communication.
Most people and subjects are a more complex than the narrow minded mindset of just wanting to get others "in trouble."
Yes I have experienced that as well. Thankfully the couple times we have had staff like that, we have ended up letting them go. That is not fun situation to be in though so I do not envy you at all.
