At this point, I’m looking forward to telling opposing counsel in this one case that I’m leaving my firm more than telling my firm. Between the ridiculous theory of the case, the truly obnoxious discovery requests, and the self-righteous attitude, I can’t wait to never talk to this guy again.

It’s a small world. You might run into him again. Don’t burn bridges.

Also, since I’m incapable of following my own advice, I quit my old firm not over one case, but over one client (a large insurance carrier) who’s in-house counsel was incredibly disrespectful. I saw him at a bar event sometime later and he had the nerve to greet me as if we were old friends. I chugged my drink and walked away from his outstretched hand. Don’t regret it at all. Fuck him and his bridge.

Discovery is like playing a video game against someone who uses the best character and spams all the power moves. Just have to play defense, be patient, stay just out of reach and then POW uppercut an MF’er

like

I'm with you there. I hate discovery and the tedious back and forth that comes along with it.

I practiced law in another country (civil law system). We don’t have discovery proceedings. It takes a long time to resolve a matter there too but I’ve never experienced this many discovery disputes bc OC has all the time in their hand to make a fuss about someone’s phone number rather than trying to resolve/settle the case.

Don’t leave a job over one case. I did and regret it immensely

Oh, it’s not just the one case. That’s just a side benefit.

I posted this somewhere else before I remembered that I am in this bowl :) so, I changed jobs 6-7 months ago and I am realizing it is not a good fit. Leadership seem to not want to hear the truth so people tell them what they want to hear and if you don’t middle management gets pissed at you. I am seriously thinking about looking somewhere else. My question is how do you answer the “why are you looking to leave” question without bad mouthing your current company?

Inspired by one of my kids' favorite books, I penned this masterpiece of an Ode to Consulting:

One senior partner all alone
Calls two managing directors on the phone
Three associate partners at the door
Bring along another four
Five senior managers come overdressed
Six managers show up with a guest
Seven senior consultants arrive in a sack
Eight associates sneak in the back
Nine analysts come to work
ALL THE CONSULTANTS GO BERSERK!!!

Ok, I'll show myself out now... 😂

Got a 30% salary bump, via an offer for Senior Consultant S&O from Deloitte. Currently underpaid at EY Advisory. I'm MBA and this year is my promotion year at EY for Manager. What to do? Get demoted and move to D? Or counter at EY? Even if EY matches my salary, and promote me to Manager, I will be an EY Manager with a Deloitte SC salary, and probably won't be able to go to D in the future. What do you think? I have built up a good relationship with my Partner and SMs at EY though.

When drafting a brief or other submissions for court or arbitration, do you use words such as clearly, erroneously, etc. to emphasize certain points? Our managing partner says that we should, but all of the writing guides for litigators that I've read repeats the mantra "show, don't tell" and explain that most judges dread such words.

I know that the politically correct thing to do here is to do whatever the managing partner wants me to do, but I just wanted to ask for other ppl's opinion.

I work in a firm that is known for litigation defense. I’ve been developing my own plaintiffs practice as well. I am able to pay the bills with my hourly defense work, which gives me time to focus on a handful of high value PI case a year on contingency. I was recently negotiating a case and was told part of the reason the claims rep/OC was jerking me around was because they didn’t see me as a plaintiffs attorney. It may seem obvious, but in my experience partners value trial experience over anything else, so get it however you can. For example, my firm will favor a former prosecutor who has seen the courtroom a lot but has no civil litigation experience (not even a depo) over a seasoned associate who has only second chaired cases with a partner but hasn’t tried a case. Even trying a case and losing gives you credibility at my firm because you still did it.
