Boss pushed me to sign an affidavit fo a closed matter I wasn’t part of. I know this crosses a line, but also aware of the internal politics.

What’s the smartest way to push back without burning bridges?

Treat it like an error and say “you may be thinking of someone else, I wasn’t involved in that one at all.”

Is there a reason to push back? You don’t need to have lived the circumstances if you can gain the necessary knowledge with a reasonable investigation. But you do need to do a reasonable investigation. Companies need to do this all the time, as employees come and go, and no single employee may deal with all the necessary facts. Just ask for the billing number for your investigation, and make sure you review whatever documents you need to, and talk with whomever you need to. And revise the affidavit so it is true. This is your perjury and bar license in the line, not the partner’s.

This^ Just make sure the affidavit is based on information and belief. That info and belief being derived from records maintained in the regular course of business at your firm in your exp. You’ll be fine and are probably overthinking this.

To build on the ideas above, you could start asking about the content of the affidavit and seeking additional interviews, and that itself may signal to the boss that they need to find someone else to rubber stamp their affidavit (if that’s your concern here).

I have observed this behavior — where an expendable associate or paralegal is asked to sign an affidavit that is controversial or risky in some way, so that the partners can then shirk responsibility or blame that person if something goes wrong.

I’m back. It turns out that some previous drafts were there for someone else to sign. No one signed it. At least two people are still around. Just refused to sign.
This is a case that settled three and half years ago.
I’m very nervous.
Are there any ethic lawyers who help ppl dealing with this? How could I find them?

Can you call your state or city bar and ask for a ethics lawyer referral? There may also be an ethics hotline at these bar associations, for free advice. The rules will be state-dependent.

How do you deal with stub years who are exceptionally bad? I’m not talking about general cluelessness which is completely expected and understandable, but turning in work product riddled with incomprehensible, grammatically incorrect sentences that would fail middle school English. Hello guys! I work as a Campus Tech, I deal with 1200 kids for a Charter K-8th grade and 100 staff. I love working with a school district due to the amount of time we have off during school and summer off. But I’m debating on the pay I feel as I’m under pay for the amount of work that I do, troubleshooting Chromebook’s, laptops, printers, & projects…anything that plugs into the wall I cover. I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

Reorgs are just a part of the corporate world. If you haven’t been a part of one in your career yet, then you most likely haven’t been in the corporate workforce for very long. If you have been a part of a reorg, however, how do you personally approach it? There are many factors at play, but in general do you try to establish relationships with the individuals you know will be key contributors and/or decision makers going forward? I practice litigation defense and recently started growing a plaintiffs practice on my own at my firm. I’ll probably bring in $300k to the firm just from that this year. Although I enter my time on these cases and they count towards my hourly goal, should I ask for a contingency % in addition to my salary moving forward?

7 year lawyer here. Been with the same big national firm all 7 years (not BigLaw) doing complex litigation. Been working remote a long time due to moving around for wife’s job. As a result of the moving was bumped off partner track. I’m looking at a great small firm that will be a practice change (but still litigation). I'm in a litigation, about 9 months in. Is it normal that I spend majority of my time making bundles for my partners (printing, binding, moving docs in a different order whenever there are new documents or he wants to add stuff) reviewing documents and making tables (e.g. dates, which documents are from where), and the only legal work is like notices of admission, list of documents, the occasional research? I'm so bored and I want to quit but I don't know if I have unrealistic expectations.

What’s the best way to turn down a 2nd interview? During the 1st interview, I learned that the compensation for the role is not within the range that I am looking for and requires 400 more billable hours a year than what I bill now.
