Yes, always best to speak up. Don’t approach it as “this is wrong because” though. Instead, address it as “I have a question about this versus how we did it on the return.” Sometimes you did it wrong and it has to be fixed. But a lot of times, the article is general and doesn’t cover all the details and your client may fall into another set of facts that are similar. Either way, you should ask to learn the answer so you don’t miss it in the future. Also, always better to find your own mistakes (or your teams mistakes) before the client, auditor or IRS. Always.

You absolutely bring it up. Just tell them you were doing research on another client and want to understand how the issue would apply to your mutual client. You could still be doing it right but are missing an exception you don’t know about
