Key point: FICA (Social Security and Medicare) is not determined by filing status. It is determined by the worker’s visa status and employment situation at the time the wages are earned.
How it works
1) F-1 visa exemption (the core rule)
• F-1 students are generally exempt from FICA on wages while they are nonresident aliens for tax purposes and working in authorized student employment.
• This exemption applies at the time wages are paid, not at filing.
2) Marriage / filing jointly does NOT retroactively change FICA
• Getting married and filing MFJ (by making a §6013(g)/(h) election) can make the F-1 spouse treated as a resident for income tax purposes.
• However, that election does not retroactively subject prior wages to FICA.
• FICA is not recalculated on the tax return. It’s handled through payroll.
3) No “true-up” on the tax return
• You do not pay FICA through your 1040.
• If FICA was incorrectly withheld, you seek a refund via the employer first, then via Form 843 if needed.
• If FICA should have been withheld but wasn’t, liability typically sits with the employer, not something you self-assess on your return.
4) When FICA does start applying
• The exemption ends when the individual becomes a resident alien under the substantial presence test (after the exempt years are used up), or otherwise no longer qualifies.
• From that point forward, FICA applies prospectively to wages.
Direct answer to the question
• No, filing jointly does not cause retroactive Social Security/Medicare tax on prior-year wages.
• The spouse’s prior F-1 wages remain FICA-exempt if they were properly exempt at the time earned.
Practical implication
• The only change from MFJ is on the income tax side (rates, credits, worldwide income inclusion), not payroll taxes already handled.
