I have heard that when a new potential employer is completing a background check, the old company is not allowed to share WHY you no longer work there. They are only sharing the dates you worked there to prove you are not lying on your resume. If they did share that you were fired or laid off, and you lost a job opportunity, you could potentially sue for defamation. Companies would rather avoid that potential lawsuit and will never share the termination reason. So it's entirely up to you how you want to proceed and what narrative you share with your potential next employer on why you are job searching.
Even though you have terms to sue them for wrongful dismissal, keep in mind the legal process takes a while, and you will have no pay cheque coming in while the process is being played out, unless you find a replacement job right away.
Signed, someone who was put on a PIP to avoid a wrongful dismissal and discrimination lawsuit. I got let go anyways in the end, even after proving they didn't follow policy and proving there was no performance issue in the beginning. I took the severance package vs. suing because I didn't want to be without pay while the legal process took place. I negotiated my severance package to something I was comfortable with and have moved on with my life. The company never rehired for my position and has let 20 new people go since my termination (company size is 200 people).
So you want to gamble on a PIP with no guarantees you will be retained versus taking a severance package?
Take the severance and negotiate (where possible). I once had a layoff where I was able to find a job 2mos before the layoff date. Job 2 assumed i would end Job 1 sometime very soon - it was amazing collecting two paychecks. Fortunately job 1 duties were super low leading up to layoff date so it wasn’t demanding on my time.
If they need to cut staff they have no intention to keep you so is there point of going through PIP as they will be going through motions and will only delay the inevitable.
How much are they offering how many months salary does it cover ? How long would the pip take you so will you earn more by delaying?
Also its better to be able to say laid off then to find a lie as to why you left as dont imagine you want to tell future employera about PIP as you come of negative.
Also if you end up staying dame industry sometimes you know same people and people are not discreet even if should be
Last point. When you are not working you will have time to look for roles and startt immediatly. PiP involve work and freeing time to takr for interviews will be harder.
One shoe doesnt fit all. Think financially and mentally which is best option.
Also remember to save positive feedback anything that highlughts situation or backs what you are saying so you have evidennce
Since they need to cut expenses and your specialty is no longer relevant, negotiate the best severance so you have income while you are looking.for a new job. Since they offered both a PIP and severance a PIP will only delay the inevitable and you will be leaving based on poor performance vs. a role elimination needed because the company needed to reduce expenses.
Take the package. Putting you on a PIP is just a way to force you out. No it is not right but it is the truth!
Take the package to leave, as the ship appears to be sinking. In the meantime, look for your speciality elsewhere, while you use the money to get ahead on rent, utilities, car loans, ins., and stock up on food. You have no grounds for unfair dismissal, but do have the letter of your dismissal on hand when you apply for unemployment.
