Im on pace to settle between $8-10M this year ($2.7-3M in fees) as pre-lit personal injury attorney, 10 years out, 1 year into new firm, Base $90k, 3% commission, I should clear $175k-$180k this year with benefits and 4% matching IRA, we have 55 employees at the firm, is it unreasonable to be wanting to clear $200k a year? $225k a reach? Don’t want to be unreasonable having only been here a year?

If you don't want to litigate and actually go to trial, you're at about the top end. Other option is to start your own practice - then worry about bringing in business, managing staff, and paying for more overhead than people realize.

like

This is a pretty standard compensation deal for a pre-lit attorney. Do you have any transparency on how you compare to other attorneys?

like

Yeah I just settled a commercial case for $1.57M prelit - gnarly accident, but majority of my cases are $25k-$250k

likefunny

How many of those cases/fees have you brought in yourself?

like

You should at least be getting a higher commission percentage for those fees you are originating! No less than 10-15%

like

I’ll hire you at my firm to run prelit and pay you more!

I received a job offer from a PI firm (MVA and tractor trailer cases) in Houston, Texas; the bonus proposed was 2.5% of attorney’s fees for any cases settled each quarter. We are assigned 50 cases a quarter and the top attorney clears $25K each quarter. This is my first time working at a PI firm. Can anyone share any guidance? Is 2.5% industry standard?
