When I was in ID, I only billed for things I personally did. So if I did the initial draft I would phrase “draft initial interrogatories and requests for production to plaintiff” so that way if the attorney went in, they could add in “edit draft of ROGS/RFPS”. Now if they’re not drafting the discovery, then something is off.
Bingo, this is exactly how my attorney and I bill for discovery, pleadings, etc. Basically anything I draft, I bill as the initial draft, he bills to finalize, and if there are revisions I need to make, I bill to revise at direction of attorney.
Paralegals bill for themselves because they often have their own billing quotas (as opposed to legal assistants). If they’re doing the work, they’re going to bill for it. But your rate is higher, so if it’s legal work that can be billed at an attorney rate, it makes more sense for you to do/bill it.
Not saying this is right but I believe there is tons of duplication and overlap bw the billing of ID paralegals and attorneys. They know it will be written down by insurance in part so they go for it on the initial bill that is submitted.
