Just started doing PI in the side at my firm so probably a dumb Q, but when you get a new auto accident client and the at-fault driver’s insurance is offering to pay for the damage to their vehicle, do you have them accept that or wait and include the amount in your demand with the medicals and other damages? If they pay before you settle, wouldn’t you recover less, as your contingency fee would be out of the subsequent settlement?

Property damage and BI (meds/other damages) are separate. They can accept the PD first.
Typically, PI firms, at least in my state, only collect contingency fees on the BI claims anyway.

Separate. Get the car repaired. Make sure you get copies of how much it cost to repair the car. Sometimes they point out the damage was not that much how dare you ask for so much money or the policy, etc. yea insurance companies are petty.

I mean, when you have people getting less than $1,000 in repairs for a low speed tear end accident but claiming hundreds of thousands in non economic damages... can’t really blame them for a developed skepticism.

Once asked someone to state their max damages over 1m for an accident and they came back with 5m. Case was hardly worth 5k

A1 is correct. Also, the client may not want to wait until the BI portion is settled before getting their vehicle fixed or compensated for their vehicle being totaled—especially if they are being treated.

Get the property damage taken care of ASAP. Slow handling of property damage is the quickest and easiest way to end up with an extremely pissed off client. Don't charge anything for the property damage.

For Plaintiff's attorneys, how big is your caseload? What kind of cases are the majority of them and are they in suit? I am currently handling 150+ mostly MVAs and premise liability cases, just about all in suit, (on top of about 10 DUIs and other small traffic matters) and I feel like I'm drowning and looking to jump ship. Sent 2 policy limits demands. Adjuster offered $60k both times because they don’t see a “causal relationship” without offering us any articulated supporting facts.

I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)

In an auto accident trial, can you inform the jury in any way that the at-fault driver had insurance? I have a hard time believing a jury would award 7-figure damages if they thought the little old lady defendant had to personally pay. I’m just starting to do PI on the side by myself at my firm, so this is probably a very dumb and obvious question.
