Finance lawyers, I’m a mid level suffering from imposter syndrome. While I generally understand financial covenants, it recently occurred to me that I have no clue WHY certain ones are included, or how they’re calculated. Like, why EBITDA instead of EBITDAX? I’m a first year associate, so this question might seem really naive to older attorneys — what the heck is bill/hours padding? I’ve seen it mentioned on fishbowl but no ones ever talked about it at my firm. Is it literally just writing down more time over actually worked or is it always working like 2 minutes on 20 matters to catch a bunch of extra time.
