I’m sorry that happened to you.
Emotions aside, there may be an opportunity here. If leadership inquires about your personal health and then subsequently terminates your employment, they are asking for a lawsuit.
Have you considered connecting with HR and requesting a generous severance? Or is there more to the story?
I second this comment. I’m so incredibly sorry for what you’ve been doing thru. I’ve been going through something similar, and it was affecting my work to the point that I felt I needed to tell my superiors what was going on.
I didn’t miss any court or client deadlines, or anything like that. I just took so long to 1) get started on projects and 2) finish them. My ADD was in overdrive, and was suffering from anxiety and depression too. I also was not good about following up that I needed more time. Those “what’s the status?” and “please get this done ASAP tonight” and “here’s a new project we need research done for in the next hour...” emails that once made me jump to get something done, had zero affect on me. I couldn’t get out of bed lots of days. Partners became more agitated and asked my ETA on assignments.
Admittedly, I didn’t schedule a meeting with the partners to specifically address my struggling mental health. Instead I chose to address it when already in conversation about something else. Having to expose these personal health issues was already unbearable, so I didn’t want to make an entire meeting about it.
The first partner I told is usually very short, always “too busy” to talk. He ignored my comments about struggling, and wanted to continue to discuss work instead, so I perceived that as a dead end. I talked to another partner, and decided to be even more clear about what I was going through. The second said “we’re all struggling, it’s a terrible situation with COVID....”. I tried a third time, with no response at all.
I also got some “but why didn’t you reach out sooner” comments. Part of depression, or at least mine, is my inability to reach out.
I realized at that point I was alone in this (at work at least) and need to figure out what to do in the event that I am terminated. Part of the frustration is not knowing whether I will be, or if that’s the last thing on their minds. I just don’t know. Prior to this, I had gotten great reviews from clients.
I am so sorry to hear this OP. Wishing the best and that you’ll find somewhere where you are valued as a person
I'm sorry OP that's terrible. Time to find new leadership
I learnt not to open up to work people too much, they can turn it against you. So many two faced ppl walking around especially at work. Stick to talking to your close friends.
Jesus this is terrible. I have been having a very difficult time recently and during a check in with my manager talked with her about it. I am thankful she responded kindly and asked how she can support. I know it’s always a risk to be honest but with all that’s been happening this past year how can anyone really be doing great? I’m sorry Op. just know you aren’t alone & I do think some managers would handle this properly. :/
Noooo, OP, please please please don’t think you did anything wrong at all. You acted in good faith, your current boss did not.
He went in with the intention of having a convo about your performance. What kind of a$$hole starts off a disciplinary convo like this?!
DO NOT let this guy steal your authenticity. He’s already done enough damage.
Sorry to hear this. You deserve far better. Move on if you can. Life is too short.
Wait what? You're better off.
Wow. What a phenomenal example of why the legal industry is way behind on combating mental health stigma.
Yeah, isn't that the truth? We're still in the dark ages for sure
You could alway register your disability with HR and then let them fire you for your disability which would then be discrimination. Ask he fir a reasonable accommodation and get a doctors note. Head it in before they take action. You have rights and deserve to protect yourself. If you had cancer would the response be the same?
I definitely think this is a good point. I have a failure to accommodate case right now with a similar fact pattern.
Sorry to hear this - I’m curious if the decision was already made prior to the call to you, or was a decision after speaking with you?
Yeah, sadly this seems to have been on their radar and this gave them the opportunity to pull the trigger. Sorry for this, and wishing you the best as you bounce back soon!
I really relate to this. Sorry this happened OP.
Sorry to hear this OP. You are definitely better off. Please take care.
That’s really cruel OP. The boss has certainly got a personality disorder, if not depression!
Fellow attorney here. Small state that has had 5 attorney suicides in January alone. It resulted in a little, much-needed push by the state bar to refocus on mental health in the profession... The way you were treated is despicable. I suggest reporting it to internal HR if you have one and your state/local bar. In general, but especially right now during covid, there is no place for this type of attitude in our profession.
