Zoom made everyone lazy. I'd never consider it a preference for the true purpose of the depo so it makes sense.
Zoom depositions are awful.
I’ve had to tell deponents to stop looking at their phone. I’ve had deponents very obviously read from a script of what allegedly happened to them.
I’ve have very strong suspicions that deponents are being coached via a chat box or something.
If I had the option I would take an in-person deposition every single time. Deponents take Zoom depositions way less seriously. This is a deposition — not a FaceTime call.
See I find Zoom depos to be more telling precisely for this reason. They get more comfortable and tell me more than they would in my stuffy conference room. It’s a lot more chill and they think I’m their friend bc I’m nice and they’re comfortable.
You’d be shocked at the games people are playing because of zoom - in person means we can see if someone is feeding the witness answers and if they’re playing with their phone etc.

Defense attys get much more info about how a witness will do at trial in person, so if the company will allow it, it’s much preferred. Many times ins companies stick to zoom in smaller cases so if you get a live one, know that the company thinks you may have a significant case.

Plaintiff’s attorney here. Defense counsel probably wants to conduct in person depositions for billable hours.
I generally prefer in person depositions, as I find that my clients prepare more seriously when they testify in person. I also find that I get more information from defense witnesses during in person depositions.
