Paper the hell out of the case, withdraw if you can’t get through to them.
I make sure I am extra careful with these types of clients. All communication in writing, speak with them on the phone as if im being recorded, etc. These clients are the type that will file a grievance if things don’t go their way, regardless of who’s at fault. Ultimately, I will end up being candid with them and will say point blank if you do not listen to me you will lose your case. Remind them that if they want to get paid, they will listen to my instructions.
At the end of the day, though, there are clients where none of this will work. And as stated above, just make sure you cover yourself and it is what it is. There’s only so much you can do.
Find out what their motivations are, or what's causing them trouble in life at the moment. Maybe they are stressed over $ and you can get them a $500-1k loan to shut em up and get your caae back on track. Maybe the pain is bad and they're not getting help from their current doctor and you can address that. Don't assume they're always idiots/assholes. If you end up there anyway, so be it. But if you can fix them by digging rather than continuing to force the square leg in the round hole then you both win.
Wait until they try to renegotiate your percentage at the end of the case.
I have a client who won’t accept a settlement offer and insists I try her case that’s worth 2500. Withdraw.
Eject! But if that’s not an option, I find retired judges as mediators can get through… sometimes…
Drop them?
Document document document. And ultimately realize it's their case and their life not yours. You give them all the facts, law and recommendations you can and they get to choose how to act. You then do the best you can with their decisions and continue to document document document.
This kind of stuff drives me insane and we see it every day. We make sure to document everything and just try to be as sticky sweet nice as we can. Often times we will end up firing clients like that.
