I did two years ago because there was a change in ownership/leasing agent right before my move. Long story short, their books didn’t add up, so I sent a certified letter asking for the check totaling XXX by a certain date. Provided proof of the original payment, proof of no damage (made sure to get a copy of the signed document when I moved out) and a mailing address. Stated that failure to provide the amount would be in breach of contract (lease usually states when they’ll refund it) and local housing laws, and would move with legal proceedings. Got the check in ~10 days.
Thank you so much. I’ll read the lease in detail again and try this approach if I do not hear back in the next few days. Most of their reviews on Google relate to them not returning security deposits so I want to make sure I approach this differently. Sigh!
What is the problem? By law they have to return it within 14 days and if they deduct, provide an itemized list of what was taken out (eg broken fridge, holes in walls, etc)

Yes Ive lived in two apts (both new rental buildings) that tried to ding me during the walk through for various issues I had already reported/were not eligible to be paid out of the deposit. E.g. at one there had been flooding damage from the apartment above and it deformed the shades. They didn’t fix them at the time they redid the floor and walls, but then said they’d need to replace them out of the deposit, and it would be like $3k.
I got the sense both times that it was part of the process that they were gonna walk through and find things. Both backed down when I chatted with management and made it clear, firmly but respectfully, that I understood the standard and it wasn’t going to happen without a fight. The law is pretty tenant protective, and I think it’s only gotten more so.
I had good overall relationships in both buildings so I was surprised. It seemed pretty shady to me because both buildings also had a high % of non-native NYers (lots of foreign doctors and grad students) and more than one told me later they didn’t realize they didn’t have to pay, they thought it was just part of the process….
Thank you for sharing and the tidbit re: the laws favoring the tenants, helped me calm down a bit.
Cite the rental deposit return statute and threaten small claims!
E-mail landlord or send a certified letter (sends you a receipt to make sure they got it so they can’t claim it wasn’t delivered/never received) to their office requesting security deposit. Happened to me a couple of years ago - sent multiple emails/letters. 2 days after filing the above complaint got a call back asking where to send the security deposit to!
