For the biglaw tax partners, do you have strong opinions on whether IRS, Big4, or DOJ Tax best prepares aspiring biglaw tax associates to join your firm? My understanding that DOJ Tax was more civil litigation than tax centric, and that the quality of Big4 experience depends on the group of which you’re a part.

I think their view is that with minor exception the ones they are willing to take come straight out of law school.

If you’re in M&A, international or WNT and don’t stay too long then maybe. But barring COVID-level hiring needs, there’s not going to be much interest unless you’re headed to some very niche practice.

Depends on the type of tax practice. I’m in SALT and we’ve hired several people from big4, but DOJ/IRS experience is largely irrelevant to our work.

Transitioning from com. lit into tax controversy?

I have a tax LLM and started my career out of law school doing M&A tax at a big4. After 9 months, I got out of big4 transactional hell and into whatever litigation I could find. I now practice commercial lit but would welcome the opportunity to eventually transition into tax controversy (which I wasn’t able to do before). Does my commercial litigation “break” hurt my prospect? How long can I stay in com lit without hurting my chances even more?

For anyone who practices tax lit in the US Tax Court, what’s your experience with the independent office of appeals? They don’t seem quite that “independent” to me and so far, I’ve only had one appeals officer who seemed knowledgeable and nice. It’s been a real headache. Has anyone dealt with stuffing allocation in a non-hedge fund context? It seems even in the HF world the law is fuzzy in using aggregate reverse 704c principles in stuffing allocations. Like, sure, the market is there but no authority really blessed it (other than some Cravath partner’s article in Tax Notes in 2013).
