I cannot understand American immigration. Where is the logic in denying people who have been living and working in your country for 5+ years but allocating tens of thousands of green cards to people who apply from overseas in a random ballot?
Seems crazy to me.

I believe there is an annual cap on the number of approved H1B visas. So the situation may not be personal and not due to the current administration but due to timing as caps get reached.
Per the attached, it looks like 65k H1B visas are issued each year with an additional 20k H1B visas for those with a masters degree. That number has held steady for 15 years and has not changed with Trump.
OP - push the attorney. Look into any extension and if you can reapply get into the process early.

I second KPMG. I am embarrassed of this administration and their lack of detailed impact analysis and planned execution as they’re rolling out these policies.
It’s a terrible thing, especially for career consultants and their families...thank the current political climate and ICE actions for this ridiculousness. Push hard on lawyers. Good luck!
@MD1 - I think the cap applies to new H-1B applicants. OP already had his visa, infact approved for green card, but just getting the visa renewed.
PSA: apply for your green card the day you start work. There is no reason to believe as a non-citizen you have an endless right to work in the US. That right doesn’t exist elsewhere, it doesn’t exist in Canada, it doesn’t exist in Europe. If you want to stay here, get your green card ASAP!

OP - sounds like you got squeezed by new policies that came earlier this year and make it harder to get a H1B if you’re deployed at a 3rd party site (like many consultants).
Per the attached, your attorney should have know this and emphasized the “specific and non-speculative qualifying assignments in a speciality occupation for that beneficiary for the entire time requested on the petition”. As a H1B is typically issued for 3 years, they would need to draft better than applications they had done in years past.

Thanks. Applied for the green card 7 years back and have i140 approval as of 4 odd years ago, but wait for anyone from india is more than 15 years min as things stand 😊
And agree there are no guarantees in business...but why stop aspiring, especially when you have no reason not to ...

Blame the current political climate. The way immigration is set up under the current administration is so ass backwards things like this happen.
Seen this happening a couple times. It’s either a lottery thing or a stonewalling with demands for more documentation. Usually works out but a harrowing experience nonetheless. In the event that it doesn’t a couple of my colleagues have had to relocate to Canada, Australia, Singapore or the Middle East offices ...or India/ China
OP - how long is your current visa active? I was in a similar situation a couple of months back. The lawyers filed my H1 again in premium and it went through without an RFE. They beefed up the application the second time around
Few of my peers applied for canadien PR. Maybe you should do that as a back up plan
While the current administration is what it is, and is understandably beyond firm’s or our lawyers control, Deloitte partners changed to a much terrible and inexperienced law firm to save few bucks. They couldn’t have chosen a worst time to do that. Maybe they weren’t expecting Trump or the current immigration situation. Terrible move nevertheless. Even if they weren’t concerned about the wellbeing of their employees, this surely will hit their pockets when they can’t staff the sold work. And I see that happening already.
Look up H1B denials on google and you’ll find that in 2017 Deloitte had the most number of H1B (new or extension) denied, more than the indian outsourcing companies like Infosys and Wipros. And they file far more H1Bs than D. It was scary to see that Deloitte H1B rejection rate was far worst than the Infosys/TCS/Wipro..
And the worst thing is that most Deloitte PPMDs aren’t even aware of this.
Op - I know someone who went through a similar situation in our firm. Leverage your network and work with global mobility. They can transfer you to one of the member firms which have partnership with US and try to get you back into US soon as possible. One thing you need make sure is the transfer is to a member firm with partnership. That way you don’t have to quit and rejoin the firm, they will simply transfer you and have your years down and growth till now in the firm locked in.
Hang tight, OP. And remember, no one can take your experience away, you are not starting from scratch. I’m sure you’ll get you H1B extension but nonetheless
I have resigned last week. My situation is very similar. I have i140 approved and never had an RFE before. GGS screwed my application, got denied and refiled. Another RFE. I was getting no response from GGS forever. I decided to answer all recruiter calls that I keep getting. Finally found a job in industry and they got my h1b visa transferred in 9-10 days for 3 years. This case just shows how terrible GGlaw is. I did not want to leave Deloitte but I will now, thanks to GGS. I am seeing people blaming current administration which is true but for Deloitte Consulting, rejections are a larger function of GGS law firm. The immigration folks at D are getting away by easily transferring entire blame on Administration which is not completely true.
