So long as not an ERISA Plan generally you’re entitled to one third, very easy process, as stated above they will need settlement details
I’d ask for a 1/3 reduction. They’ll probably want some information about the settlement, such as the settlement amount, your fee, other bills/liens and whether you’re seeking other reductions or reducing your fee.
1/3 goes to meds so you’ll need to explain the overall meds that have outstanding liens, and your own costs & fees. You always have the hardship argument to fall back on too; the client should generally walk away with at least 1/3, so if the lien reductions cut into that, you can argue hardship to the client for them to cut their liens further down.
Idk if this applies to you at all, but I had a rep from Rawlings tell me that they don’t need to be told the gross settlement if it includes property damage; he said they only need to be told about the bodily injury portion of the settlement, which can greatly reduce the amount that’s disclosed to them and the amount that they’ll base their reduction on.
Yep typically we will ask for a 1/3 reduction. As mentioned we always have to provide them with the settlement amount to get them to reduce the lien but that is a fairly easy process.
