If I were a trucking defense attorney. What happens if I’m in an accident and the at fault party is my client? Can I sue or is that a conflict of interest?

Or maybe use your good relationship with your client to tell them that you were hit by one of their trucks and ask for compensation in a non-adverse manner

like

Trucks have insurance

like

It would be unethical to both represent your client in one matter and sue them in another.

like

You just get waiver from the client. It happens all the time.

I think you’d withdraw from representing them and sue them lol. You’d probably need to hire an attorney to represent you and not represent yourself

like

State ethics line is where I’d start. Your firms GC is going to cover themselves and their clients before you. Some ethical instances conflict out the whole firm. There are shielding provisions etc but if it is a trucking defense firm and you’re suing a trucking company who is also a client, they likely don’t want you in the building. I do health care ops and wouldn’t want to sue a client for malpractice. It’s a rough place to be. If this is just a hypo ignore this but I hope you and your family are doing ok.

like

No. A lawyer cannot be adverse to a current client.

Is informal pre-suit resolution "adverse?" Or does adverseness commence upon filing? Im sure states differ, but it seems comparable to a client that falls well behind on their bill - my interest in getting paid is adverse to theirs, but no conflict arises until I file a collection action.

This is when you need to reconsider your life choices and leave the dark side behind.

Call the ethics line for your state bar

You probably should notify your firm GC now. Until the claim is settled you have a conflict and probably can't work their cases

I let the shame spiral get the better of me this week. Realized that I wasn’t going to be able to meet a deadline because I’d mismanaged my time and the project was more complex than I though. Rather than admit the mistake and suggest a new deadline, I just kept saying I’d send it tomorrow/later/so on. And then I stayed up basically three days straight working, which has only made me slower and more inefficient. So I’m still not done and now I’m in the pits of anxiety and exhaustion hell. FML.

I’m a second year associate at a small, but reputable firm. My caseload is almost entirely made up of clients who were referred to one of the partners but the partners are too busy so I end up taking the case. The clients are told up front that an associate, rather than a partner will be taking his/her case. I’ve run into an issue a couple of times where the client doubts my advice because I am only 2 years in. Has anyone else experienced this? How do I address the fact that I’m only 2 years in?
