I’m a mid-level/senior (read: pigeonholed) patent prep/pros associate who is getting burnt out by the grind. I refuse to accept that the only options are keep churning patent applications, or to go in-house to manage attorneys who churn patent applications. I would love nothing more than to expand my practice, but the legal community doesn’t view us patent folk as real attorneys. Is there any hope?

Yes, we do (I’m a transactional/corporate attorney). We view all of you patent folks as real attorney, but we have no idea what you do or how to explain it to others to be honest. Honestly, half the issue is that most of you value the undergrad, masters, or PH.D higher than the law school, so in a way patent attorneys devalue the rest of us regular law folk. If you are normal, can connect with clients, and can do those patents that you all circulate conflicts reports for that none of us can understand let alone pronounce, you’ll be good and successful.

Also, stop saying all you do is patents. You protect the intellectual property revenue producing assets of the enterprises you represent. Start saying that.

Thanks for your response P1. I’d like to think of myself as normal, at least relative to the average patent attorney.

I guess my jadedness comes from knowing that most of my work product will end up having no value and/or won’t positively impact society. Most inventions that I work on involve minor incremental improvements to technology.

The best part of my job is working with small/pro bono clients. I feel like a lawyer advising them, and they appreciate our work a lot more than our large institutional clients. I would love to be a GC for a tech company, but I would need some non-patent transaction/corporate experience.

Based on what it sounds like your long term goals are, try and get some specialist work from the corporate folks at your firm. (Or, if you’re at a patent pros shop, lateral to a firm with broader practice areas.)

I’m in patent lit, but over the years I’ve done portfolio diligence for M&A, patent valuation for Bankruptcy/Restructuring, and lots of license negotiation as part of my own practice. There’s lots of ways to use your specialized skill set to assist other groups at your firm, and expand your own toolbox at the same time.

OP - that was my experience. I’m in house now and got most of the training in house.

Tech trans / licensing work. Unless you can get someone in your firm’s tech trans group to adopt you you will probably have an easier time lateraling somewhere else that hasn’t slotted you as patent pros.

Q’s for hiring partners and recruiters - you know that most associates quit their managing attorneys and not the firm/case. I’m in that boat. What do I say to a prospective employer about the situation of why I want to jump ship?

Very brief background - I’m a senior associate who has been on one complex commercial litigation case for over a year. Over time, the relationships between attorneys on the case have deteriorated to the point that it is affecting my productivity/work. I want out.

When does the recruiter-candidate relationship really end? Everyone says ~6 months but is that 6 months of radio silence? Or is that 6 months from when you authorized to submit apps. Do you have to reapply after 6 months? Nothing is really clear. And what’s to stop someone from just terminating the relationship and reapplying by themselves. Do you avoid going to shows and concerts that restrict use of electronics? I want to go to a comedy show during the week, but there's a disclaimer that they kick you out If you're checking phone/smart watch, etc. I'm also thinking of shows where they put your phone in one of those dumb locking bags

How do you get good at thinking on your feet? I find I always need time to think and analyse before being able to answer client queries (even those that are considered simple by others). I don't want to rush and get it wrong. I avoid phone calls for this reason which isn't great when you're in the service industry so it's starting to impact my career.
